Please fill in the information below in order for your to complete your waiver for rentals.

Rental Equipment Policy and Liability Waiver

1. Assumption of Risk
By renting equipment from Surfnturfrec.llc, the Renter acknowledges and accepts all risks associated with the use, transportation, installation, and operation of the equipment. The Renter assumes full responsibility for the safety and proper handling of all rented items.

2. Release of Liability
To the fullest extent permitted by law, the Renter hereby waives, releases, and discharges Surfnturfrec.llc, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur from the use or misuse of the rented equipment, whether caused by negligence or otherwise.

3. Indemnification
The Renter agrees to indemnify, defend, and hold harmless Surfnturfrec.llc from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorney’s fees) arising out of or in connection with the Renter’s use, possession, or transportation of the equipment, including any claims by third parties.

4. Condition of Equipment
All equipment is inspected and deemed in working condition prior to rental. It is the Renter’s responsibility to inspect the equipment upon receipt. Any concerns must be reported immediately. Failure to report issues within 1 hour of possession will be deemed acceptance of the equipment in good condition.

5. Proper Use
The Renter agrees to use the equipment solely for its intended purpose and in accordance with all applicable laws and manufacturer guidelines. Surfnturfrec.llc is not responsible for damages or injuries caused by misuse, improper setup, or failure to follow safety instructions.

6. Loss or Damage
The Renter is fully responsible for any loss, theft, or damage to the equipment during the rental period, regardless of fault. The Renter agrees to pay the full replacement cost or repair costs as determined by Surfnturfrec.llc.

7. No Warranties
Surf 'N Turf provides rented equipment “as is” and makes no warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

8. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws principles.

By checking the box associated with this policy, the Renter acknowledges that they have read, understood, and agreed to the terms outlined in this policy and voluntarily release Surfnturfrec.llc from any and all liability.

Rental Equipment Return Policy

Rental Equipment Return Policy

1. Standard Return Procedure
All rented equipment must be returned by the agreed-upon return date and time specified in the rental agreement. Equipment must be returned in the same condition as it was issued, with all included components, accessories, and packaging.

2. Early Returns
Early returns are allowed; however, no refunds, credits, or price adjustments will be issued for unused rental time unless otherwise specified in writing.

3. Late Returns
Returns made after the scheduled return time are subject to additional charges. A daily late fee per item may apply until the equipment is returned. Continued non-return may result in additional penalties and legal action, including full replacement costs.

4. Damaged or Missing Equipment
All items must be returned clean and in working condition. The Renter will be held responsible for any damage, missing components, or excessive wear beyond normal use. Charges for cleaning, repairs, or replacement will be billed to the Renter at Surfnturfrec.llc's sole discretion.

5. Inspection Upon Return
All returned equipment will be inspected within 48 hours. If damage is discovered or items are missing, the Renter will be notified and invoiced accordingly.

6. Abandoned Equipment
If equipment is not returned within 7 days of the scheduled return date and no communication has been received, Surfnturfrec.llc will consider the equipment abandoned. The Renter will be responsible for the full replacement value of the items, and legal action may be pursued.

7. Cancellations & Refunds

Before Pickup: Cancellations made more than 48 hours before scheduled pickup are eligible for a full refund.

Within 48 Hours: Cancellations made less than 48 hours before pickup may be subject to a cancellation fee of up to 50% of the rental cost.

After Pickup: No refunds will be issued after the equipment has been picked up or delivered.

8. Equipment Drop-Offs
If Surfnturfrec.llc is responsible for pickup/drop-off, the Renter must be present at the scheduled time. Missed appointments may incur rescheduling or delivery fees.

9. Refund Process
All approved refunds will be issued via the original payment method within 5–10 business days after approval. Refunds will not be issued for time lost due to misuse, operator error, or failure to follow proper operating procedures.
